Terms & Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right of withdrawal;

Consumer: the natural person not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
-
Day: calendar day;
-
Long-term transaction: a distance contract concerning a series of products and/or services with obligations spread over time;
-
Durable medium: any tool that enables the consumer or entrepreneur to store information for future reference and unaltered reproduction;
-
Right of withdrawal: the consumer's right to withdraw from the contract within the cooling-off period;
-
Entrepreneur: the natural or legal person offering products and/or services remotely to consumers;
-
Distance contract: a contract concluded between the entrepreneur and consumer through a system for distance selling using only remote communication technologies;
-
Remote communication technology: a means to conclude a contract without the need for physical presence;
-
Terms & Conditions: these general terms and conditions of the entrepreneur.
Article 2 – Applicability

These Terms & Conditions apply to every offer and distance contract between the entrepreneur and the consumer.

Before concluding a contract, the consumer will be provided with these terms. If not reasonably possible, the entrepreneur shall indicate where they can be reviewed and sent upon request, free of charge.

If the contract is concluded electronically, the terms will be provided in such a way that they can be easily stored.
-
If specific product or service conditions apply in addition to these terms, the most favorable provision for the consumer shall prevail in case of conflict.
-
If any provision is invalid or void, the remaining provisions remain in full force.
-
Situations not covered by these terms must be assessed in the spirit of these terms.
-
Ambiguities are interpreted according to the spirit of these terms.
Article 3 – The Offer

If an offer is valid for a limited time or subject to conditions, this will be clearly stated.
-
All offers are non-binding. The entrepreneur reserves the right to change or withdraw offers.
-
The offer includes an accurate description of the product or service. Images reflect the product truthfully but may vary in color.
-
Obvious mistakes or errors do not bind the entrepreneur.

Each offer clearly states:
-
The price (excluding import VAT and clearance fees—these are paid by the customer upon delivery in the EU);
-
Any applicable shipping costs;
-
The method of contract formation;
-
Whether the right of withdrawal applies;
-
Payment, delivery, and execution details;
-
The offer's validity or guaranteed price period;
-
Whether the contract will be archived;
-
How consumers can review or correct their data;
-
Available languages, applicable codes of conduct, and relevant legal info.

Article 4 – The Agreement

The agreement is concluded once the consumer accepts the offer and meets the stated conditions.

If accepted electronically, the entrepreneur will confirm receipt immediately. Until then, the consumer may cancel the agreement.

The entrepreneur takes appropriate technical measures for secure electronic transactions.
-
The entrepreneur may assess the consumer’s creditworthiness and decline orders or set conditions if justified.
-
Upon delivery, the entrepreneur provides the following:
-
Details on the withdrawal right or its exclusion;
-
Warranty information;
-
All legally required details unless already provided.
-

For long-term contracts, item 5 only applies to the first delivery.
-
The agreement is subject to availability of the products.
Article 5 – Right of Withdrawal
-
The consumer has the right to cancel the contract within 14 days after receiving the product.
-
During this period, the consumer must handle the product with care and only unpack it to the extent necessary to assess it.
-
If the right of withdrawal is used, the consumer must notify the entrepreneur within 14 days (e.g. by email), then return the product within another 14 days.
-
The consumer must prove the product was returned on time, e.g. with a tracking receipt.
-
If the consumer fails to meet the deadlines, the purchase becomes final.
Article 6 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.
-
If the consumer already paid, the entrepreneur will refund the amount within 14 days of receiving the returned item or proof of return.
Article 7 – Exclusion of Withdrawal
The right of withdrawal may be excluded for certain products/services, provided this is stated clearly before purchase.
Exclusions may apply to:

Products made to consumer specifications;
-
Personalized items;
-
Perishable goods;
-
Products with fluctuating prices on financial markets;
-
Newspapers and magazines;
-
Sealed audio, video, or software if the seal has been broken;
-
Hygiene-sensitive products with broken seals.
For services, exclusion applies to:
-
Lodging, transport, catering, or leisure on a specific date;
-
Services with explicit consumer consent before the cooling-off period ends;
-
Bets and lotteries.
Article 8 – Pricing
-
Prices remain fixed during the offer period, except for VAT rate changes.
-
Products/services with variable market prices may fluctuate—this will be stated.
-
Price increases within 3 months after the contract are only allowed if legally required.
-
After 3 months, price increases are only valid if agreed and the consumer can cancel.
-
Deliveries are from outside the EU. Consumers are responsible for paying import VAT and clearance fees upon delivery.
-
All prices are subject to typographical and printing errors.
Article 9 – Compliance & Warranty
-
The entrepreneur guarantees the product meets the agreement and general standards of usability and reliability.
-
Additional factory warranties do not limit statutory consumer rights.
-
Defects or incorrect deliveries must be reported in writing within 14 days. Returns must be in original, undamaged condition.
-
Warranty equals the factory’s guarantee. The entrepreneur is not liable for suitability for individual purposes or misuse.
-
Warranty is void if:
-
The product has been altered or repaired;
-
Misused or not used according to instructions;
-
Affected by government regulations.

Article 10 – Delivery & Execution

The entrepreneur will process orders with due care.
-
Delivery is to the address provided by the consumer.
-
Delivery occurs within 30 days unless otherwise agreed. Delays give the consumer the right to cancel for free.
-
If delivery fails, a substitute item may be offered. Right of withdrawal still applies.
-
Risk of loss or damage transfers when the consumer receives the product.
Article 11 – Long-Term Contracts: Termination & Renewal
Termination:
-
Consumers may cancel open-ended contracts at any time with one month's notice.
-
Fixed-term contracts may be cancelled at the end with one month's notice.
-
Cancellation must follow the same method as the contract was made.
Renewal:
4. Fixed-term contracts may not renew silently, except:
-
Trial subscriptions for printed media may renew for up to 3 months;
-
Consumers may cancel renewed contracts at any time with one month's notice.
Duration:
6. For contracts longer than one year, the consumer may cancel anytime after one year with one month’s notice unless otherwise justified.
Article 12 – Payment

Unless otherwise agreed, payments must be made within 7 working days of the cooling-off period.
-
For services, the term starts upon order confirmation.
-
The consumer must report incorrect payment info immediately.
-
In case of non-payment, the entrepreneur may charge reasonable collection fees.
Article 13 – Disputes
All agreements under these terms are governed solely by Dutch law, even if the consumer resides abroad.
Article 14 – Complaints Procedure

Complaints must be submitted clearly and completely within 7 days of discovery.
-
The entrepreneur responds within 14 days. If more time is needed, the consumer is informed.
-
If a complaint cannot be resolved mutually, it qualifies as a dispute.
-
A complaint does not suspend the entrepreneur’s obligations.
-
If the complaint is justified, the entrepreneur will repair or replace the product at no cost.
